By an application of 15.9.2008 Ms. Nisha Priya Bhatia of Naraina, New Delhiapplied to the CPIO, Research & Analysis Wing of the Cabinet Secretariat (RAW)seeking the following information:

Because, as is held by us above, the information now sought from theCPIO is different to that sought in the initial application, as admitted in thehearing by appellant Ms Bhatia in alleging faulty drafting of the application, thisappeal is unsustainable and is hereby dismissed. However, it will be open toappellant Ms. Nisha Priya Bhatia to move a fresh application before the CPIORAW seeking information on the matters which she has now sought at the levelof the second appeal. Her right to so move an application notwithstanding thelisting of RAW in the Second Schedule is upheld in light of proviso to sec. 24(1)which reads as follows:
The Gurgaon police today arrested senior RAW officer Nisha Bhatia, alias Nisha PriyaBhatia, on charges of beating up a colleague and his wife, and damaging property.
Nisha Priya Bhatia, a senior RAW officer had in 2008 filed a complaint alleging sexual harassment by A.K. Chaturvedi , was arrested, compulsorily retired, and put in a hospital for ‘medical illness’. The Central Administrative Tribunal (‘CAT’) today ordered the central government to re-instate her with immediate effect. He said the instructions can be issued based on the CIC order.

Dattu as the next Chief Justice of India (CJI), on a plea filed by an advocate and former Research and Analysis Wing (RAW) woman officer who alleged sexual harassment by him.
A division bench of Chief Justice G. Rohini and Justice Pradeep Nandrajog dismissed the plea of Nisha Priya Bhatia, who sought the recommendation of the government to the President to appoint Justice Dattu as the next CJI be quashed.
"Once the presidential approval is there, we can't do anything. It's not a matter of interference," said the bench.
During the hearing, Additional Solicitor General Sanjay Jain, appearing for the central government, opposed Bhatia's plea to quash the recommendation, saying the President has approved the appointment of Justice Dattu as the next CJI on Sep 5.
The ASG also argued that the petition is frivolous and should not be entertained.
Alleging sexual harassment, the 51-year-old Bhatia in her plea has said: "Quash recommendations reported to have been made by government - as council of ministers - to the President to appoint Justice H.L. Dattu as the Chief Justice of India."
Bhatia in her plea has alleged that she was a law student in 2011 when Justice Dattu began hearing all her court cases in the Supreme Court, her work place.
"He (Dattu) has since then contributed to her acute and intense sexual harassment even though - under the Vishakha guidelines of the apex court itself - he was obliged to protect her against it, even from the third party," the plea said.
The plea said Justice Dattu dismissed all her cases and she had also filed complaints against him with police, the National Commission for Women and the Delhi Commission for Women.
Bhatia, a 1987 batch Class 1 executive cadre officer in the RAW, was compulsorily retired from the service in 2009. 6...............................However, keeping in view the spirit of the order dated 28.04.2011 passed by this Hon‟ble Tribunal, the Respondent once again reiterates the averments made in para 5 of the reply dated 14.03.2012. On further consideration of the matter, it is submitted that in furtherance to the offer made earlier in the reply dated 14.03.2012, the Respondent is prepared to treat the period of her absence as "Child CareWP(C) No.3704/12 & CM Nos. 7772,7774,8894,9629 & 10289/12 Page 8 Leave". In that case, the Applicant (Ms. Nisha Priya Bhatia) shall have no pecuniary loss. As already submitted earlier, the total period of her absence is - 29.08.2008 to 26.11.2009. As per the in-house enquiry conducted by the Jt. Secretary, period from 07.04.2009 to 09.06.2009 (63 days) could be considered as "on duty", giving her the benefit of doubt, after considering the copy of attendance register.
